Workers' Compensation

Unfortunately in our society, where hard working employees engage in strenuous work activities, injuries are inevitable. It is critical that employees who are injured and unable to work receive appropriate compensation.

Marla A. Joseph, Esq., of counsel to the Law Offices of Andrew S. Abramson is an experienced member of the Pennsylvania Workers' Compensation Bar who has represented injured workers in all phases of Workers' Compensation claims. Ms. Joseph has successfully litigated Workers' Compensation cases before Workers' Compensation Judges, the Workers' Compensation Appeal Board Commissioners and Pennsylvania Appellate Courts.

It is critical that you involve a qualified Workers' Compensation attorney whether you have been denied benefits or even if you are currently receiving Workers' Compensation benefits in order to fully protect your rights. Ms. Joseph will make sure that your rights are protected and secure the Workers' Compensation benefits to which you are entitled under the Pennsylvania Workers' Compensation Act.

Are you Eligible for Benefits?  If you are an employee who is injured on the job and you have missed 14 or more days of work, you are entitled to a wage loss benefit and the payment of your medical bills.

Do Not Assume.  Just because you are currently receiving a workers' compensation check from your employer or its workers' compensation insurer, you should not assume that you are receiving everything to which you are entitled.

Now is Not Forever.  Just because you are currently receiving benefits does not mean that those benefits will continue in the future. The law provides Employers with opportunities to attempt to stop paying benefits for which you need to be prepared. Ms. Joseph's experience will help you be prepared to counter these tactics and protect your rights.

Benefits Beyond Wages and Medical Bills.  In addition to wage loss benefits, under certain circumstances you may also be entitled to other benefits if your injury involves:

  • Visible Scars and Burns on your Neck or Face
  • Loss of Use of a Body Part or Body Function

Penalties, Interest and Attorney's Fees.  If your employer or its insurer does not deal with you fairly you may also be entitled to Penalties, Interest and /or Attorney's Fees under the Pennsylvania Workers' Compensation Act.

Our Services

Currently Receiving Benefits.  If you are currently receiving benefits Ms. Joseph will monitor your claim at no charge to successfully navigate you through the complex provisions of the Pennsylvania Workers' Compensation Act. You will only be charged a contingency fee if your claim is challenged by your employer.

Not Receiving Benefits.  Ms. Joseph will assess your claim and determine if you are eligible for Workers' Compensation Benefits. Our Fee is paid on a contingency basis, which means we are paid from a recovery only when our firm is required to litigate your case and we prevail, or when we successfully negotiate a final settlement.

Unsure If You are Receiving Everything that You Deserve.  If you are not receiving all compensation to which you are entitled, we will evaluate your claim. You will only be charged a contingency fee if we have to file a claim to obtain the compensation to which you are really entitled, or if your claim is challenged by your employer.

Social Security Benefits. If you have a disability, which may prevent you from returning to gainful employment for at least one year, you may also be eligible for Social Security Disability benefits. Ms. Joseph has successfully litigated claims before Social Security Administrative Law Judges and the Social Security Appeals Council.
