Age Discrimination

The Age Discrimination in Employment Act (ADEA) and the Pennsylvania Human Relations Act provide protections against discrimination against people over the age of 40. A typical age discrimination case may involve a claim that an employee who is over 40 years of age who was treated differently in the workplace than someone under 40. A claim may also involve two individuals over 40, such as someone over 60 years of age being treated differently than someone who is 45. Like other forms of discrimination, the nature of the unlawful action may be a wrongful termination or some other adverse act.

OLDER WORKER'S BENEFIT PROTECTION ACT

Additional protections are provided in conjunction with the Age Discrimination in Employment Act. The Older Worker's Benefit Protection Act (OWBPA) requires that individuals over the age of 40 be provided 21 days to consider any agreement waiving their rights under the ADEA and have an additional seven days after signing it to revoke their signature. The OWBPA has a significant impact on severance agreements.
